1. Acceptance of Terms
By accessing or using DataTrack PPM ("the Application"), developed by Odysseus Digital, you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, please refrain from using the Application.
2. Description of the Application
DataTrack PPM is a low-code Project and Portfolio Management solution built on the Microsoft Power Platform. It enables users to manage Financials, Resources, Demand, and Strategy for project and portfolio management. The Application is available through Microsoft AppSource.
3. User Responsibilities
Account Registration: You may be required to register for an account to access certain features of the Application. You agree to provide accurate and complete information during registration and to keep this information up to date.
Compliance: You agree to use the Application in compliance with all applicable laws and regulations.
Prohibited Activities: You shall not:
Modify, distribute, or create derivative works based on the Application without prior written consent from Odysseus Digital.
Circumvent or attempt to circumvent any security measures implemented in the Application.
Use the Application to transmit any harmful or malicious code.
4. Intellectual Property
All intellectual property rights in the Application, including but not limited to software, content, and trademarks, are owned by Odysseus Digital or its licensors. Your use of the Application does not grant you any ownership rights.
5. Privacy and Data Protection
Your use of the Application is subject to Odysseus Digital's Privacy Policy, which outlines how we collect, use, and protect your personal data. By using the Application, you consent to the practices described in the Privacy Policy.
6. Limitation of Liability
To the maximum extent permitted by law, Odysseus Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
Your use or inability to use the Application.
Any unauthorized access to or use of our servers and/or any personal information stored therein.
7. Indemnification
You agree to indemnify and hold harmless Odysseus Digital and its affiliates from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of your use of the Application or violation of these Terms of Use.
8. Modifications to the Terms
Odysseus Digital reserves the right to modify these Terms of Use at any time. We will notify you of any changes by updating the "Last Updated" date at the beginning of these terms. Your continued use of the Application after any such changes constitutes your acceptance of the new Terms of Use.
9. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which Odysseus Digital is established, without regard to its conflict of law principles.
